ARC Standards
and Guidance

The ARC has adopted these standards to provide

specifics about modifications that are permitted.

AWNINGS, SHUTTERS OR SUN / PRIVACY SCREENS CCR Sections 12.14 and 12.47 Color/pattern should be consistent with surrounding exterior paint (walls, trim, accent colors)

CAGE and LANAI, Construction CCR Section 12.14, 12.33 and 12.41 Cage must be bronze Cage must not be wider than the widest point of the home, must not exceed the height of the home and should stay within all easements The roof of the cage must be standard mansard style Refer to Manatee County for permit and setback requirements

CAGE and LANAI, Rescreening or repainting CCR Section 12.14 and 12.33 If no changes to footprint, design, color, or style no ARC is required, any change from the previous cage does require an ARC. (Rescreening the same cage or repainting with the same color does not require an ARC).

DRIVEWAYS, Painting or Staining CCR Section 12.31 ARC form required to paint or stain an existing driveway. Colors should compliment exterior paint of home (walls, trim, accent colors)

DRIVEWAYS and WALKWAYS, replacing CCR Section 12.31 ARC form required to replace existing driveway if changing original material or footprint (example, concrete to paver brick driveway) Type of material to be used with color sample (no asphalt or shell is permitted) Colors should compliment exterior paint of home (walls, trim, accent colors)

ENTRYWAY SCREENING, full frame and door CCR Section 12.14 and 12.33 ARC form required to add or replace an entryway screening Must be a plain, unobtrusive design (security ribs, scrolls, or small design are acceptable) Retractable screens at front door are allowed Metal frame should match existing lanai cage color (bronze) or trim around door

EQUIPMENT, A/C Units, pool equipment, water treatment equipment, generators, etc. CCR Section 12.36 and 12.48 (Also see section 15.9 regarding drainage easements) ARC form required to add new equipment. (Note: No ARC form required for repairs or replacing existing equipment.) Plantings are required to screen item from public view Mini-split AC cannot be wall mounted Refer to Manatee County for permit and setback requirements

EXTERIOR PAINTING, house, trim, windows, gutters and downspouts, doors, etc. CCR Section 19.7 ARC form required when any colors are changing. (Note: Repainting in the same color is considered a “repair” and no ARC form is required.) No two adjacent homes may be painted with the same exterior color scheme

EXTERIOR HOME LIGHTING (including within lanai) Landscape lighting is covered in a later section CCR Section 11.3, 12.10 and 12.26 ARC form required for permanently installed lighting (including along eaves of home and within lanai) Exterior lighting installed on the eaves of the home should be white, except as part of holiday/seasonal lighting. See Section 12.10 in the CCRs for the time periods related to federal holidays, Halloween, and Thanksgiving through January 15th. Lights that can be programmed to transition from one color to another, or programmed to turn on and off in a defined pattern are not allowed, except where such lighting would conform to, and be considered seasonal lighting. All exterior lighting shall be shielded so that direct rays from the lighting are directed toward the ground and do not cross a property line. If the lighting plan incorporates sound/music, decibel levels must be set at a non-nuisance level (daytime 55 dB, nighttime 45 dB)

FENCE CCR Section 12.14 ARC form required for any new fencing. No front yard fences allowed. Side yard fences will be considered on a case-by-case basis. Fences shall be limited to black powder-coated aluminum not exceeding 4 feet in height No wire mesh, chain link fences Gates may not open onto neighbor’s property or common property Fences may connect to adjacent homeowner fences if written homeowner agreement is provided with ARC request If a fence is installed within a drainage easement and SWFWMD requires access for repairs, the homeowner is responsible for all expenses associated with repair and replacement of the fence. Refer to Manatee County for permit and setback requirements

FENCE, invisible fences/electronic pet enclosures CCR Section 12.14 ARC form required for any new or reconfigured invisible fencing.

FLAGPOLE CCR Section 12.34 ARC form required for any new flagpole not physically attached to the house. The flagpole should be no higher than 20 feet or the tallest point of the home, whichever is taller. The flag pole may not be installed any closer than ten feet (10') from the back of the curb, or within ten feet (10') of any Lot boundary line. Refer to Manatee County for permit and setback requirements

FRONT DOOR, replacement CCR Section 19.7 ARC form required when any front door is being replaced Must be hurricane proof or hurricane protected Repainting the front door to the same color does not require ARC review Color should be consistent with exterior paint of home (walls, trim, accent colors)

GARAGE DOORS, replacement CCR Section 19.7 ARC form required when any garage door is being replaced. (Note: must be hurricane proof or hurricane protected) Doors shall be made of embossed galvanized steel

GARBAGE AND TRASH (screening of containers) CCR Section 12.18 and 12.36 All garbage cans and other garbage containers should be kept inside the garage or within an enclosed area in a location approved by the ARC Garbage and trash containers shall be screened to conceal them from view of neighboring Lots and streets from view outside of the lot except when being made available for pickup Acceptable screens shall be of material and color compatible with the design of the residence and may include landscaping or fencing. If enclosed, overall height of the enclosure, including posts shall not exceed four (4) feet. Overall length shall be kept to the minimum necessary to accomplish the screening. If plantings are used for screening, “adequate screening” shall be plantings which initially (i.e., when first planted or installed) screens a minimum of eighty percent (80%) and which completely screens the cans or equipment within one (1) year from the date of approval. Garbage and other refuse may not be accumulated or stored on any portion of the Lot. Refer to Manatee County for permit and setback requirements

GUTTERS & DOWNSPOUTS CCR Section 19.7 ARC form required for any new or replacement gutters/downspouts. Gutters must be bronze, white or the color of the house soffits or fascia; downspouts must be bronze, white or the color of the house or gutters.)

HURRICANE SHUTTERS CCR Section 12.19 ARC form required for any new or replacement Hurricane Protection Devices. Plywood and similar wooden materials are not acceptable. Permanently installed Bahamas shutters are allowed; the shutters should remain opened when not being used as hurricane protection Roll down shutters (metal or screen) must be housed in material that is the same color as the home or the home's trim. These shutters should remain opened when not being used as hurricane protection CCR Section 12.19 covers the timeliness of shutter installation and removal Refer to Manatee County for permit requirements

LANDSCAPE LIGHTING (installed in plant beds) CCR Section 11.3 ARC form required for any new permanently installed landscape lighting Solar lighting does not require an ARC review. All landscape lighting should be directed toward plantings and/or the home and should not cross property lines.

LANDSCAPING and TREES CCR Section 11.3 ARC form required for any new trees, tree removal or any enlargement of existing beds. Replacing or changing plants in existing beds does not require an ARC. Resodding or mulching does not require an ARC. If planting in a drainage easement, homeowner must assume all responsibility for the removal of the planting if required in the future Must ensure plantings do not obstruct vision of traffic Running bamboo will not be approved as part of landscaping plans

OUTDOOR KITCHEN CCR Section 19.7 ARC form required for any new outdoor kitchen only if gas or electric is being installed, a new wall is being built or is being built outside the lanai

PAVERS, replacements, or expansions CCR Section 12.12 and 12.31 ARC form required for any new paver work. (Note: not required if only replacing certain worn or broken pavers) Color should be consistent with exterior paint of home (walls, trim, accent colors)

PLAYSETS CCR Section 12.35 ARC form required Must be located at the rear of the lot and inside portion of corner lot Refer to Manatee County for permit and setback requirements Placement should follow the Consumer Product Safety Commission to allow sufficient space around the equipment for safety as well as consideration of adjacent property.

POOLS/HOT TUBS, construction and installation CCR Section 12.40, 12.41 ARC form required for most pool work. (Note: not required if only resurfacing the pool and/or replacing existing but worn, broken or out of date tiles. The pool cannot be built over any drainage easements. Silt fences required before digging No above ground pools are allowed. Above ground spas/hot tubs are allowed if screened from view by landscaping or existing walls (such as the lanai walls). If plantings are used for screening, “adequate screening” shall be plantings which initially (i.e., when first planted or installed) screens a minimum of eighty percent (80%) of the height and which completely screens the height or equipment within one (1) year from the date of approval. Pools and enclosures may not extend beyond the sides of the home and may not be higher than the roof line of the home. No features of the pool should exceed 2 feet above the natural grade of the lot. Refer to Manatee County for permit and setback requirements

ROOF REPLACEMENT CCR Section 12.31 ARC form is required only if changing the color or materials Metal roofs are allowed Refer to Manatee County for permit requirements

SOLAR PANELS CCR Section 19.7 ARC form required to add or replace solar panels. Conduit or other piping running on the roof must be painted to match the roof color Front of house/Street facing should be avoided, unless that is south facing. No ground mounted solar panels are allowed. Refer to Manatee County for permit requirements

WINDOW REPLACEMENT CCR Section 19.7 ARC form required only if the color or style of the window frame changes (example, double hung, casement, picture, etc.) Windows must be hurricane proof or protected. If only replacing some windows they must match existing windows. Refer to Manatee County for permit requirements
